Germany needs 400 nurses for Triple Win Project


The Philippine Overseas Employment Administration is now accepting qualified applicants for nurses for deployment in Germany under the Triple Win Project.

The International Placement Service of the German Federal Employment Agency (ZAV/BA). This time, needs qualified applicants to fill up its vacancies for ICU, general, and geriatric care wards.

The Triple Win Project is supervised by the POEA through a government-to-government arrangement with the Federal Republic of Germany.

Qualified applicants must be Filipino citizen and permanent resident of the Philippines with Bachelor of Science in Nursing (four years professional education), active Philippine Nursing License and at least two years of professional experience as nurse in hospitals, rehabilitation centers and care institutions.

Applicants must have German language proficiency and is willing to undergo German language training in the Philippines to attain Level B1 (to be paid by the employer) or with Bl or B2 language proficiency level in accordance with the Common European Framework of Reference for Languages.

Successful candidates shall have a starting monthly salary of €1,900 (gross) and an increase to € 2,300 after recognition as a qualified nurse.

The employer will pay the visa and airfare from the Philippines to Germany and will assist the employee find a suitable accommodation. The selected nurse will bear the expenses in full or in part of the board and lodging.

OFW Guide: How To Get Overseas Employment Certificate (OEC) Online

The Philippine Overseas Employment Administration (POEA) makes document processing easy by offering Overseas Filipino Workers (OFW) to secure their Overseas Employment Certificate (OEC) online.

Here is the guide on how to get OEC via the Balik-Manggagawa website (bmonline.ph)

Get your Overseas Employment Certificate (OEC) online.

  1. For new users you should have an EMAIL ADDRESS. Then register in this system as NEW USER and click the “Sign Me Up” button. Click the confirmation link sent to your registered email address.
  2. Log in as ALREADY REGISTERED user. Then, enter your last issued OEC number or Passport number. If no record is found, set an Online Appointment.
  3. If record is found, update your Personal Data, Contract Particulars and upload photo. Click “NEXT STEP” then ACQUIRE OEC.
  4. On the Assessment/Payment page, select your preferred PAYMENT OPTION (Banks Online, Banks over the Counter, Non Banks, G-cash and more) to get REFERENCE NUMBER and pay OEC to chosen payment channel.
  5. When payment is done, log in as ALREADY REGISTERED user using your registered email and password, then click “MY TRANSACTIONS” and print your OEC in 3 copies and bring to the airport for: a) Airline Company for Travel Tax Exemption, b) Airport Counter for Terminal Fee Exemption, and c) Bureau of Immigration Counter.

Husband and Wife Nabbed For Illegal Recruitment



DOLE Secretary Silvestre H. Bello III has directed the immediate prosecution of a couple caught in the act of illegal recruitment.

The CIDG Anti-Transnational Crime Unit, at the instance of the Anti-Illegal recruitment Operatives of the Philippine Overseas Employment Administration (POEA), arrested Stephanie M. Valdez and her spouse Jhoan "Khalil" Yuen, for recruiting overseas Filipino workers without the proper license from the POEA.

Administrator Hans Leo J. Cacdac reported to DOLE Secretary Silvestre H. Bello III the arrest of Valdez and Yuen, which resulted from the complaint of an applicant who said she was promised a job as household service worker in Qatar and was charged a placement fee of Php 65,000.00.

In an entrapment operation inside a supermarket in Quezon City, the joint operatives recovered from the couple the marked money the applicant supposedly paid to the recruiters as additional placement fee.

The applicant said Valdez initially asked her to pay Php 20,000 for processing her papers but she was able to pay Php 14,000 only.

Valdez allegedly directed her to proceed to an agency to sign an employment contract and for stamping of visa, and was asked to pay Php 35,000 for placement fee to Valdez' husband Khaleel Yuen.

Cacdac said the applicant decided not to push through with her application, and sought counsel from the POEA Legal Assistance Division, where she was told that she must pay a total of Php 65,000 placement fee, an amount higher than the amount previously agreed upon.

Under POEA rules and regulations, domestic workers shall only be recruited by POEA-licensed recruitment agencies, which are prohibited to charge any placement fees from domestic worker recruits or applicants.

In the case of the household worker victim of Valdez and Yuen, she was also told to declare that she only paid an amount equivalent to one month's salary as placement fee. Note that payment by a household worker of one month's placement fee is still illegal under POEA rules and regulations.

Recovered from the recruiters were two pieces of Php 500 bills used in the entrapment operations.

The recruiters were brought for Inquest Proceedings before the Department of Justice, for Illegal Recruitment punishable under R.A. No. 8042, as amended, and Swindling under the Revised Penal Code.

Secretary Bello ordered Administrator Cacdac to closely monitor the DOJ proceedings and the eventual criminal case that will be filed before a Regional Trial Court.

The respondents waived their rights under Article 125 of the Revised Penal Code to avail of Preliminary Investigation, and are detained in a detention facility.

All You Need To Know About Illegal Recruitment

 What is illegal recruitment?  Here is a detailed definition on what is illegal recruitment according to Philippine Overseas Employment Administration (POEA) website.

Any act of canvassing, enlisting, contracting, transporting, utilizing, hiring or procuring workers and includes referring, contract services, promising or advertising for employment abroad, whether for profit or not, when undertaken by a non-license or non-holder of authority contemplated under Art 13 (F) of Presidential Decree No. 442, as amended otherwise known as the Labor Code of the Philippines: Provided, That any such non-licensee or non-holder who, in any manner, offers or promises for a fee employment abroad to two or more persons shall be deemed so engaged. (sec. 6, RA 8042).

It shall likewise include the following acts, whether committed by any persons, whether a non-licensee, non-holder, licensee or holder of authority.

(a) To charge or accept directly or indirectly any amount greater than the specified in the schedule of allowable fees prescribed by the Secretary of Labor and Employment, or to make a worker pay any amount greater than that actually received by him as a loan or advance;

(b) To furnish or publish any false notice or information or document in relation to recruitment or employment;

(c) To give any false notice, testimony, information or document or commit any act of misrepresentation for the purpose of securing a license or authority under the Labor Code;

(d) To induce or attempt to induce a worker already employed to quit his employment in order to offer him another unless the transfer is designed to liberate a worker from oppressive terms and conditions of employment;

(e) To influence or attempt to influence any persons or entity not to employ any worker who has not applied for employment through his agency;

(f) To engage in the recruitment of placement of workers in jobs harmful to public health or morality or to dignity of the Republic of the Philippines;

(g) To obstruct or attempt to obstruct inspection by the Secretary of Labor and Employment or by his duly authorized representative;

(h) To fail to submit reports on the status of employment, placement vacancies, remittances of foreign exchange earnings, separations from jobs, departures and such other matters or information as may be required by the Secretary of Labor and Employment;

(i) To substitute or alter to the prejudice of the worker, employment contracts approved and verified by the Department of Labor and Employment from the time of actual signing thereof by the parties up to and including the period of the expiration of the same without the approval of the Department of Labor and Employment;

(j) For an officer or agent of a recruitment or placement agency to become an officer or member of the Board of any corporation engaged in travel agency or to be engaged directly on indirectly in the management of a travel agency;

(k) To withhold or deny travel documents from applicant workers before departure for monetary or financial considerations other than those authorized under the Labor Code and its implementing rules and regulations;

(l) Failure to actually deploy without valid reasons as determined by the Department of Labor and Employment; and

(m) Failure to reimburse expenses incurred by the workers in connection with his documentation and processing for purposes of deployment, in cases where the deployment does not actually take place without the worker's fault. Illegal recruitment when committed by a syndicate or in large scale shall be considered as offense involving economic sabotage.

Illegal recruitment is deemed committed by a syndicate carried out by a group of three (3) or more persons conspiring or confederating with one another. It is deemed committed in large scale if committed against three (3) or more persons individually or as a group.

The persons criminally liable for the above offenses are the principals, accomplices and accessories. In case of juridical persons, the officers having control, management or direction of their business shall be liable.

POEA administrator hails signing of executive order on FOI

Administrator Hans Leo J. Cacdac yesterday said the Philippine Overseas Employment Administration (POEA) welcomes the signing of the Executive Order on freedom of expression by President Rodrigo R. Duterte on July 24.

Cacdac said the FOI executive order will boost public accessibility to information and accountability in government offices, which will further strengthen efforts to serve and protect OFWs and their families.

Cacdac said with its existing ISO-certified systems and processes, the POEA aims for continuous improvement of OFW service delivery with greater transparency and integrity, and sustains its compliance with the requirements of the Anti-Red Tape Act (ARTA).

Cacdac said he has asked the POEA’s internal ISO Committee to start preparing the People’s Freedom to Information Manual as required of government agencies by the Executive Order.

The executive order covers all agencies under the executive branch, including government-owned and controlled corporations and state universities and colleges.

Under Section 15 of the said order, any employee or public officer who will fail to comply with the provisions of the EO may face administrative and disciplinary sanctions.

POEA Cancels License Of LAM Healthcare Staffing Corporation

The Philippine Overseas Employment Administration has ordered the cancellation of the license of LAM Healthcare Staffing Corporation which was found liable in separate recruitment violation cases filed against the recruitment agency.

Administrator Hans Leo J. Cacdac said the recruitment agency violated several provisions of the POEA rules and regulations including illegal charging of placement fee, multiple cases o f misrepresentation and deploying an underage worker.

LAM Healthcare was held answerable for deploying an underage domestic worker to Oman which the Philippine Overseas Labor Office (POLO) in Muscat reported to the POEA as a probable case of trafficking in person.

The HSW was deployed to Al Ain, United Arab Emirates on February 1, 2013 but was later transferred to an Omani sponsor who brought her to the Sultanate. Complaining of overwork, she escaped from her employer’s home on May 23, 2013 and took shelter at the OWWA Center in Muscat.

During the interview with the welfare officer, the HSW admitted that she was only 21 years old when she was deployed having been born on October 16, 1991. She claimed that her recruiter brought her to Cotabato to secure a fake birth certificate prior to her passport application at the Department of Foreign Affairs in Manila.

POEA Governing Board Resolution No. 6, Series of 2006, as amended, prescribes the minimum age of HSW applicants at 23 years old.

In another case, the POEA found LAM Healthcare liable for excessive collection of placement fee when it charged Php30,000.00 from the worker whose monthly salary was only Php12,318.75 as irrigation laborer in Saudi Arabia. Under the Rules, a land - based recruitment agency may charge and collect from its hired workers a placement fee in an amount equivalent to one month salary, exclusive of documentation costs.

The recruitment agency was also held responsible for misrepresentation when it deployed the worker as a laborer but whose actual work was delivery service crew. The worker was eventually repatriated because of the discrepancy in the position stated in his Iqama and his actual job.

LAM Healthcare was previously penalized for submitting fake OWWA - CPDEP Training Certificates for processing of its hired household service workers at the POEA’s Land - based Center. “We have consistently ruled that misrepresentation cannot only be committed to the applicant - worker but also to the POEA itself. In this case, the agency is liable for leading us to believe that the training certificates were authentic,’ Cacdac said. Under the POEA rules on recruitment violation cases, deploying underage workers and excessive collection of fees on the first offense, and misrepresentation on the third and subsequent offenses, carry the penalty of cancellation of license.

POEA Warns Public of Spam Emails

POEA Administrator Hans Leo J. Cacdac said the Philippine Overseas Employment Administration does not send mass e-mail and advised recipients of e-mails supposedly coming from his office to ignore them especially those that instruct clicking an attachment.

He said the POEA informs recruitment agencies about administrative actions or decisions on adjudication cases by means of sheriff or courier service but not through e-mail. Cacdac said recipients should treat such e-mails with caution, especially those with attachments.

“E-mail spammers commonly use attachments to sneak viruses into the victim’s computer. They even trick you to into sharing personal information like passwords or credit card numbers”, said Cacdac.

Cacdac said many recruitment agencies reported to him that they received e-mails purportedly coming from the POEA’s official e-mail address with ‘Notice of Suspension’, ‘Banned Agencies’, Suspension/Banned Notification’ and ‘Best Recruitment Agency for 2014’ as subjects. Cacdac said it was easy to detect the e-mail as fraudulent because the sender has no name and position title and the letter was poorly written.

Recruiters of Factory Workers to Japan Face Illegal Recruitment Cases

The Philippine Overseas Employment Administration is filing illegal recruitment cases against the owner and staff of an establishment found to have been recruiting  overseas Filipino workers without a valid license or authority from the government.

Administrator Hans Leo J. Cacdac identified the recruitment agency as Jomhadz International Corporation, and its alleged owner, a certain Joan Sigua.

Operatives of the POEA Anti-Illegal Recruitment Branch and Anti-Transnational Crime Unit (ATCU) of the CIDG closed down last week its main office located at 2nd Floor, Claveria Building, Circumferencial Road, Barangay Dalig, Antipolo City and its satellite office at 1660 Neptuno St., Paco, Manila.

The POEA officers have verified from applicants that Jomhadz International was recruiting Filipino workers for a wine factory in Japan and charges a placement fee of Php150,000.00.

The POEA prosecution team is preparing illegal recruitment charges against Sigua and her staff identified as Jefferson S. Flores, Charton Villanueva, Renalyn P. Cuevas, Renato V. Padilla, and Jason P. Cabus.

The CIDG-ATCU seized from the office employment documents of applicants, including passports, for inventory and as documentary evidence.

Cacdac advised applicants of Johmadz International to proceed to the POEA Anti-Illegal Recruitment Branch for filing of complaints against the recruiters.

POEA Cancels License Of Non-Stop Overseas Employment

Administrator Hans Leo J. Cacdac has ordered the cancellation of the license of NonStop Overseas Employment Corporation for submitting two different visas and after committing three counts of violation of the POEA regulation on misrepresentation. 

Cacdac said Non-Stop had requested for processing of a worker bound for Qatar with a visa as General Cleaner but after verification was found to be in the category of a Secretary. 

Non-Stop claimed that the real job order for the worker was for the position of secretary and it mistakenly submitted the visa for general cleaner. The agency tried to correct the supposed error and submitted a visa for a secretary. 

Upon further scrutiny, however, the POEA found out that except for the position titles, the two visas have the same issuance and validity dates, visa number, visa type, duration of residence, and other markings. 

Cacdac said Labor Secretary Rosalinda Dimapilis-Baldoz has instructed the POEA to prioritize resolution of recruitment violation cases involving household service workers (HSWs) and other low-salaried overseas Filipino workers. 

Section 2 (e) of Rule I, Part VI of the 2002 POEA Rules and Regulations Governing the Recruitment and Employment of Land-based Overseas Workers prohibits licensed recruitment agencies from engaging in acts of misrepresentation in connection with recruitment and placement of workers such as furnishing or publishing any false notice, information or document in relation to recruitment or employment of an OFW.

POEA Cancels Recruiter’s License Over Excessive Placement Fee

POEA Administrator Hans Leo J. Cacdac has ordered the cancellation of license of Goodman International Manpower which was found to have collected exorbitant placement fee from an OFW who worked as a manicurist in Singapore.

The complainant against Goodman International alleged that an employee of the recruitment agency required her to pay Php40,000 as partial placement fee. She paid the amount from the proceeds of a Php147,000.00 loan she obtained from a lending company. The rest of the money went to Goodman’s counterpart agency in Singapore.

The worker further testified that Goodman did not issue her a receipt corresponding her payment and she was deployed to Singapore using a tourist visa. She resigned from her work after only three weeks.

Aside from cancellation of license for violation of the POEA rule on placement fee, Cacdac meted Goodman International the penalty of nine months suspension of license or a fine of Php450,000.00 each for collecting placement fee without issuing a receipt, misrepresentation, and deploying workers whose employment and travel documents were not processed by the POEA.

Cacdac also ordered the disqualification of the officers and directors of the agency from participating in the business of recruitment and placement of overseas Filipino workers.

3 POEA Recruitment Agencies Suspended For Human Trafficking

POEA Administrator Hans Leo J. Cacdac ordered the preventive suspension of Empleos Incorporated, Nahed International Manpower Services, and Ridzkey Human Resources International Services , which were found to have illegally deployed Filipino workers to Jordan using Dubai, United Arab Emirates as transit point. 

Cacdac said the three agencies used the same scheme of having the documents of the OFWs processed at the POEA for work in the UAE , but upon arrival in Dubai, the workers are transferred to planes bound for Jordan. 

Cacdac said the POEA motu propio filed administrative complaints against the three agencies after receiving memo s from the Philippine Overseas Labor Office in Jordan re quest ing assistance for immediate repatriation of OFWs deployed by the agencies. The workers ran away from their respective employers and are currently staying at the Filipino Workers Resource Center in Amman.

"The scheme employed by the respondents is a prima facie case of trafficking - in - persons considering the fact that the workers were officially processed for UAE but the y were deployed instead to employers in Jordan that are not accredited or registered with the POEA,"

Cacdac said in his order. The recruitment agencies also failed to immediately repatriate the affected workers even with persistent requests for repatriation from the POEA and the workers themselves. Cacdac said he issued the order of preventive suspension against the three agencies because there are reasonable grounds to believe that the ir continued operation will lead to further violation of POEA rules and regulations , and exploitation of applicants for overseas jobs . Cacdac also ordered the inclusion of the names of the respondents in the POEA list of agencies temporarily disqualified to recruit and deploy Filipino overseas workers pending investigation of the cases filed against them.

Balik Manggawa Online Processing

The Philippine Overseas Employment Administration advised Balik - Manggagawa or vacationing Overseas Filipino Workers to use its online system to get an Overseas Employment Certificate (OEC) or exit clearance instead of lining up at the POEA office and its processing centers.

Administrator Hans Leo J. Cacdac said BM Online or the Balik - Manggagawa Online Processing, which will be officially launched October 16 , is intended not only to get rid of queues but also to speed up the process at the convenience of vacationing OFWs.

“With the new system, a returning OFW can now apply online for the OEC and have the approved OEC printed by him/her anywhere , anytime. With the existing database sharing with the Bureau of Immigration , the updated information of OFWs who have successfully secured their OEC using the system will be automatically shared with the Bureau . This facilitates the validation by the immigration officers at the airport of the OEC being presented by the bearer,” Cacdac said.

Cacdac said BM Online is available only for workers on vacation, rehired, or returning to the same employer, and with exi sting record in the POEA database. A Balik - Manggagawa or returning worker who does not meet the said criteria will be redirected to the BM Appointment page for regular processing of OEC on a chosen date and time and preferred processing site of the worker.

Workers using the system will have to pay Php100 for processing fee and Php19.50 for e - payment service fee. The system is now available at bmonline.poea.gov.ph. and can likewise be accessed through the POEA website.

POEA Padlocks Travel Agency For Illegal Recruitment Charge

Operatives of the Philippine Overseas Employment Administration and members of the Marikina City Police last week closed down a travel agency allegedly involved in the recruitment of Filipino workers for overseas jobs.

Deputy Administrator Amuerfina R. Reyes, POEA officer-in-charge, identified the travel office as Jamea and Angels Travel Consultancy Services located at 2nd floor, Tancy Building, Barangay Molino, Parang, Marikina City which is owned and operated by a certain Jamea Lawas Barreon.

The POEA operatives reported that they have gathered evidence that Ms. Barreon was recruiting OFWs for overseas jobs. The officers found passports and resume of applicants on the tables, and lists of job vacancies for Korea, Canada, Israel, Japan and New Zealand and framed photos of applicants “scheduled to depart” posted on the office walls.

Travel agencies are not allowed to recruit and deploy Filipino overseas workers.  Under Republic Act No. 8042, as amended by Republic Act No. 10022, any act of hiring Filipino workers when undertaken by one without license or authority from the POEA is considered illegal recruitment.

When interviewed, Barreon readily admitted that she was recruiting overseas workers with the help of a certain “Christian Benito” whom she alleged to be an employee of the Department of Foreign Affairs.

Reyes said the POEA is preparing charges of illegal recruitment against Barreon and her office staff Julietta Balcruz Capistrano, and their names will be included in the POEA’s List of Persons with Derogatory Record.
